Terms and conditions of sale
What we undertake, what you undertake, and what the law provides regardless of what either of us writes.
The French version of these terms is the binding one. This translation is provided for your convenience; in case of any discrepancy, the French text at atelierdolivier.com/cgv prevails.
Article 1 — Who sells, and to whom these terms apply
These terms govern sales concluded on atelierdolivier.com between:
- L’ATELIER D’OLIVIER, a simplified joint-stock company with a sole shareholder (SASU) with share capital of €10,000, registered office at 1 rue de Milly, 77930 Perthes, France, registered with the Melun trade and companies register under number 849 071 832, hereinafter “the Atelier”;
- and any person placing an order on the site, hereinafter “the buyer”.

Article 2 — Acceptance
Placing an order constitutes acceptance of these terms. The terms applicable to an order are those in force on the day it is placed: a later amendment does not apply to it.
Should any clause be declared invalid, the others retain their force. The fact that the Atelier does not rely on a clause at a given moment does not amount to waiving it later.
Article 3 — The products
Photographs are staged compositions. Each arrangement is unique: it follows the day’s delivery, the season and the florist’s hand. The colour and size ordered are respected; the flowers making it up may vary, at an at least equivalent quality.
Vases and containers offered as options are sold separately, unless otherwise stated on the product page.
Article 4 — The order
The information entered by the buyer is binding on them. In the event of an error in the recipient’s details, the Atelier cannot be held liable for a delivery that proves impossible.
The order becomes final upon payment. A confirmation email summarising the order is sent to the buyer.
For funeral pieces, the buyer states the time of the ceremony and the type of place. This information determines the delivery time.
Article 5 — Prices
Prices are shown in euros, inclusive of all taxes, excluding delivery charges. Delivery charges are displayed before payment, in the order summary.
The Atelier may change its prices at any time; the applicable price is the one displayed at the time of the order.
Article 6 — Payment
Payment is made online by bank card or PayPal, at the time of the order. Payment data travels over an encrypted connection and is never stored by the Atelier.
Article 7 — Delivery
The Atelier delivers throughout mainland France and to Monaco, seven days a week. Pieces from the Oscendence range are also delivered to Luxembourg. French overseas departments and territories are not served.
Any order placed before 12 noon opens up same-day delivery. Delivery takes place from morning until evening, with no guaranteed time slot: the hour depends on the round and on the town. Funeral pieces are the exception and are delivered before the stated time of the ceremony.
7.1 Partner workshops
In order to fulfil an order, in particular where the delivery address is far from our own workshops, the Atelier may have the arrangement made by a partner florist’s workshop, selected by us for the quality of its work and held to the same standard.
This changes nothing for the buyer: the Atelier alone remains liable to the buyer for the proper performance of the order, in accordance with article L221-15 of the French Consumer Code. It is to the Atelier, and to the Atelier alone, that the buyer addresses any complaint.
7.2 Dispatch by carrier
Certain products, in particular dried and preserved flowers, may be dispatched by a carrier such as Chronopost rather than delivered by a florist. The method of dispatch and its price are stated before payment.
For such dispatches, the risk of loss or damage passes to the buyer — or to the recipient they have designated — when the parcel is taken into possession, in accordance with article L216-2 of the French Consumer Code. If the parcel is visibly damaged on receipt, we recommend making reservations with the carrier and informing us.
If delivery does not take place within the stated period, the buyer may, after having instructed the Atelier to deliver within a reasonable period, terminate the contract and obtain a refund under the conditions of articles L216-6 and L216-7 of the French Consumer Code.
Article 8 — Right of withdrawal
The right of withdrawal does not apply in the same way to all our products. The distinction rests on their nature, not on our choice.
8.1 Fresh flowers, plants and arrangements: no withdrawal
In accordance with article L221-28 4° of the French Consumer Code, the right of withdrawal cannot be exercised for goods liable to deteriorate or expire rapidly. Fresh flowers, plants and floral arrangements fall within that exception.
The same applies, under article L221-28 3°, to creations made to the buyer’s specifications or clearly personalised.
8.2 Dried flowers, vases and non-perishable items: fourteen days
For products that are neither perishable nor personalised — in particular dried and preserved flowers, vases and decorative items — the buyer has fourteen days from receipt to withdraw, without having to give reasons or pay any penalty.
To exercise it, simply inform us of your decision by an unambiguous statement, by email or by telephone, before the period expires. You may use the form below, without obligation.
Products are returned no later than fourteen days after your decision is communicated. Return costs remain at your expense. You may open and examine the product as you would in a shop; you are liable only for any diminished value resulting from handling beyond that.
The refund is made no later than fourteen days after the goods are recovered or proof of their dispatch is provided, using the same means of payment as the order.
8.3 Model withdrawal form
To be completed and returned only if you wish to withdraw from the contract.

Article 9 — Legal guarantees
All products sold by the Atelier benefit from the legal guarantee of conformity and the legal guarantee against hidden defects, under the conditions set out below. These guarantees apply irrespective of any commercial warranty.
Legal guarantee of conformity
The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity where a lack of conformity appears. During that period, the consumer need only establish the existence of the lack of conformity, not the date on which it appeared.
The legal guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. If the consumer requests repair but the seller imposes replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and be fully refunded against return of the goods, if:
- the trader refuses to repair or replace the goods;
- repair or replacement takes place after thirty days;
- repair or replacement causes major inconvenience to the consumer;
- the lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a reduction in price or to termination of the contract where the lack of conformity is so serious as to justify immediate price reduction or termination. The consumer is then not required to request repair or replacement first. The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee until the repaired goods are delivered.
The rights set out above arise from articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be raised to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
Legal guarantee against hidden defects
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect, and no more than twenty years from delivery of the goods. This guarantee gives the right to a price reduction if the goods are kept, or to a full refund against their return.
Article 10 — Complaints
Fresh flowers are living and fragile. So that a complaint can be dealt with usefully, we ask you to inform us within twenty-four hours of delivery, with a photograph if possible. This period is a practical request intended to allow us to establish the facts; it in no way restricts the legal guarantees set out in article 9.

Where a lack of conformity is established, the Atelier proceeds to replacement or refund, without prejudice to the buyer’s rights under the legal guarantees.
Article 11 — Personal data
The data provided when ordering is used to process the order, deliver it and keep you informed. It is passed on only to those who take part in performing it — partner florist, carrier — and for that purpose alone.
In accordance with the General Data Protection Regulation, you have rights of access, rectification, erasure, restriction, portability and objection. You may exercise them at contact@atelierdolivier.com, and lodge a complaint with the CNIL, the French data protection authority.

Article 12 — Consumer mediation
In accordance with article L612-1 of the French Consumer Code, the buyer may have free recourse to a mediator with a view to the amicable resolution of a dispute, after having attempted to resolve it directly with us by a written complaint. The Atelier has appointed:

Article 13 — Governing law and jurisdiction
These terms are governed by French law. This choice does not deprive a consumer buyer residing in another European Union State of the protection afforded by the mandatory provisions of their country of habitual residence, pursuant to Regulation (EC) No 593/2008, known as “Rome I”.
In the event of a dispute with a non-trader buyer, the courts having jurisdiction are, at that buyer’s choice, those of their place of residence, those of the defendant’s residence, or those of the place of actual delivery. With a trader buyer, the courts of Melun have exclusive jurisdiction.
Terms and conditions of sale applicable from 30 August 2026. They replace those of 15 May 2020.
